Terms of Service

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

You are responsible for account credentials, API keys, and activity under your account. Notify us promptly at support@qwythos.ai of unauthorized access. We may suspend accounts that present security, abuse, or legal risk.

Qwythos provides hosted AI inference, including chat and API access to configured models (e.g. Fast / Quality tiers). Features, models, latency, availability, and rate limits may change. Beta or early-access capacity (including GPU hardware limits) may be constrained without liability for downtime or queueing.

Paid plans (currently Pro at approximately $49/month for about 2M tokens/month and 30 API requests/minute, subject to the live pricing page and plan records) are billed in advance via our payment processor (Stripe). Unused monthly tokens do not roll over unless we expressly state otherwise. Hard quotas apply; overage is not enabled by default. See the Billing & Refunds policy for details.

You must comply with our Acceptable Use Policy. You may not use the Service for illegal activity, exploitation of minors, fraud, malware, unauthorized access, or other prohibited categories listed there. We may investigate and suspend or terminate access for violations.

You retain rights to prompts and content you submit (“Inputs”). You grant us a limited license to process Inputs and generate outputs solely to provide, secure, maintain, and improve the Service, enforce policies, and comply with law. You represent that you have all rights needed to submit Inputs and that Inputs do not violate law or third-party rights.

Model outputs (“Outputs”) may be inaccurate, incomplete, offensive, or unsuitable. Outputs are not professional advice (legal, medical, financial, or otherwise). You are solely responsible for evaluating and using Outputs. See the AI Disclaimer.

The Service, branding, software, and documentation are owned by us or our licensors. Except for your Inputs and your rights in Outputs as between you and us (subject to model provider and open-source terms), no rights are granted except as expressly stated.

API keys are confidential. Do not share them. You must implement reasonable client-side and server-side safeguards. Abuse, scraping of non-permitted surfaces, or attempts to bypass quotas/auth may result in immediate suspension.

Personal data is processed as described in our Privacy Policy and, where applicable, Data Processing Addendum.

The Service relies on providers such as hosting, authentication, databases, payment processors, and GPU/inference infrastructure. Their outages or changes may affect the Service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM.

You will defend and indemnify us against claims arising from your Inputs, Outputs you distribute, misuse of the Service, or violation of these Terms or law.

You may stop using the Service at any time. We may suspend or terminate access for breach, risk, non-payment, or legal requirements. Provisions that by nature should survive will survive termination.

We may update these Terms by posting a revised version with a new “Last updated” date. Material changes may be communicated by email or in-product notice where appropriate. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of [GOVERNING LAW — e.g. Romania / EU Member State], without regard to conflict-of-law rules. Exclusive jurisdiction: [EXCLUSIVE COURTS — e.g. courts of Bucharest, Romania], except where mandatory consumer protections require otherwise.
